Terms & Conditions

The Order

  • An order for a garment, as specified in a client order form (“the Order”) by you (“the Client”) from Carl Stuart Tailors Limited (“CST”) will only be deemed confirmed and come into effect when payment for the Order has been received in accordance with clause 2 below.

  • The Client and CST agree that the Order will rely on selections made and details supplied by the Client, including garment style, material, form of payment, and delivery address for the garment(s), if requested.

  • The Client shall be responsible for ensuring that all details on the Order are accurate and to the Client’s satisfaction. Once the order is confirmed, all cancellation, amendments and refunds are at the discretion of CST.

The Price and Payment

  • The Client will be charged the price quoted for the garment ordered from CST at the time that the Order is placed with CST. This price will be determined by reference to various factors, including the material selected and any additional specifications requested by the Client, in accordance with the CST price list.

  • Charges for delivery of completed garment(s) shall be in addition to the price of garments in the Order and such delivery charges will be quoted upon request.

  • CST reserves the right to modify the prices charged for its products without notice, save that the terms of any pre-existing Order, confirmed in accordance with clause 1 above, shall prevail.

  • Payment for the Order shall be by credit/debit card or cash. 50% of the order is required at the time when the order is placed before it is processed.

Delivery

  • In order to provide the best level of service, CST will require a final fitting of any newly-made garments with the Client at CST premises; any new garments required in writing by the Client to be dispatched without following this procedure will be the Client’s responsibility and at the Client’s own risk.

  • Delivery will normally be within agreed upon time from confirmation of the Order in accordance with clause 1 above. However, delivery can take longer on Orders due to circumstances beyond our reasonable control, including (without limitation) delay due to cloth availability, components availability, working holidays, strikes, sickness, Client availability to attend fittings, trunk show schedule and stores opening time.

  • When required by the Client, delivery costs shall be supplied by CST upon written request by the Client and shall be charged to the Client accordingly.

  • For the avoidance of any doubt, no garment(s) will be delivered or released without full and final settlement of the total value of the Order, including any additional delivery charges.

  • Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we will have no liability to pay any money to you by way of compensation.

  • We shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control including (without limitation) delay or failure caused by adverse weather, strikes, transport problems, wars or Act of God.

Quality Guarantee

  • CST will produce a garment to the Client’s specifications in accordance with the style options and adapting the measurements stated in the order to the CST pattern block. Furthermore, all garments will undergo a meticulous quality check before dispatch (if applicable). Should the client have any reason to believe that the garment supplied by CST has developed a fault since the previous fitting or should any garment not fit any Client as reasonably anticipated, the Client shall be required to contact CST in 3 days from collection, specifying the fault in detail.

  • Any request for further alterations after this period cannot and will not be considered under any circumstances.

  • In the event that CST assess to be responsible for any error, CST will make reasonable alterations to rectify the problem on a timely basis. This process can involve the order to go through repair it or replace it steps to refine the fit of a bespoke garment and can take multiple fittings.

Refund

  • As each order is personally tailored, we are unable to resell an order to any other Client other than the Client placing the order, hence orders which have been finished cannot be refunded or exchanged.

  • Refunds are only offered if there is a fault in the production of the garment after repair and replace steps. An order can be considered faulty following the procedures of repair and replace after inspection of the goods by CST.

Right for you to cancel your contract

  • You cannot cancel your order if the goods you have ordered are made to your specifications or are personalised and cannot be resold.

Cancellation by us

  • We reserve the right to cancel the order between us if: A) there is insufficient stock to deliver the goods that you have ordered or B) one or more of the garments you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from the cloth mills/suppliers.

  • If we do cancel your order, we will notify you by email and will recredit to your account any sum deducted by us from your original payment method as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

CMT Orders

  • CST will reserve the right to accept or refuse a CMT order.

  • CST will assess the cloth to ensure there is sufficient amount and to review its pattern repeat and condition. Each CMT order will require up to 3 extra weeks to process the order to allow the fabric to be processed to avoid contamination.

  • CST will not be responsible for any damage to the cloth during and after the completion of the order.

 

Communication

  • Should more than 6 months pass without a response from the Client to a fitting/collection invitation or a question from CST pertaining to an order or orders; CST reserves the right to cancel the order.  CST will attempt to contact the Client twice via email and in the event that no response is received, the order will be considered canceled and the initial 50% payment will be non-refundable. 

General

  • All rights and other intellectual property arising from the order shall remain the exclusive property and/or under the exclusive control of CST.

  • If any part of these terms is found to be void or un-enforceable by any court of competent jurisdiction such part shall be severed from these terms which will otherwise will remain in full force and effect, notwithstanding the foregoing nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded.

  • In the event of any dispute, English law shall apply and the courts of England & Wales shall have exclusive jurisdiction.
